TERMS AND CONDITIONS OF SERVICE

SHAWN MCMAHAN, MCMAHAN’S HOOFCARE requires that you have read and agree to the following terms and conditions. Within these terms, the following terminology applies to these Terms and Conditions, Privacy Statement, and Disclaimer Notice and any or all Agreements:

  • ‘Client’, ‘You’, and ‘Your’ refers to you, the client or client’s representative using McMahan’s Hoofcare’s services and therefore accepting the Company’s terms and conditions.
  • ‘The Company’, ‘Ourselves’, ‘We’, ‘Us’, ‘Me’, ‘Myself’, and ‘I’ refers to McMahan’s Hoofcare, based in Penn Valley, California, primarily doing business within the state of California.
  • ‘Party’, ‘Parties’, or ‘Us’ refers to both the Client and Ourselves, or either the Client or Ourselves.
  • ‘Animal’, ‘Animals’, ‘Horse’, ‘Pet’, ‘Livestock’, and other animal related phrases refer to the animal(s) receiving our care, regardless of species or type of care administered.

All terms refer to the offer, acceptance, and consideration of payment necessary to provide services to the Client in the most appropriate manner.

WHAT YOU CAN EXPECT FROM ME, YOUR HOOFCARE PRACTITIONER

  • I will behave with integrity and honesty with you, the Client.
  • I will provide you with naturally based hoof care, advice, and support.
  • You will be contacted the day before to verify your appointment.
  • I will arrive on time (within a 1 hour window) for your appointment.
  • If I am unavoidably delayed, you will be notified immediately, via phone call or text, assuming cellular signal is available.
  • You and your animal will be treated with respect.
  • I will refer you to another professional if it will be in the best interest of your animal.
  • We will discuss in advance options and fees for additional work – I have a strict “no surprise bills” policy.
  • If working on your animals becomes unsafe for the animal, me, or bystanders, I will advise you of the options before proceeding.

WHAT IS EXPECTED FROM YOU, THE CLIENT

  • Complete an intake questionnaire for each animal.
  • To be open and honest with me.
  • Provide me with all the information necessary to help your animals.
  • Be committed to providing for your animal’s welfare.
  • Provide a safe, dry, well-lit work area.
  • Adhere closely to my recommendations, especially regarding trim schedule and care between appointments.

SCHEDULE

  • Client must adhere closely to a regular service schedule. Standard trim cycle is 4-6 weeks. I will determine the length of your animal’s trim cycle, starting with a 4 week cycle. Trims beyond an 8 week cycle will be charged extra for a rehabilitation trim.
  • Appointments are available to be scheduled Monday, Thursday, and Friday between the hours of 8:30am and 3:00pm. Hot weather effects available appointment times.
  • CANCELLATIONS: If your appointment is canceled less than 24 hours before the appointment, a fee of 50% of the expected work will be charged and must be paid before a new appointment may be scheduled. Not responding to the confirmation text or call is considered a cancellation. No-shows and last minute cancellations (day of appointment) will be charged a fee of 100%of the expected work and must be paid before a new appointment may be scheduled.

ANIMAL AND HANDLING

  • Animal must be trained and well mannered, used to having its hooves and legs handled. Work will stop if the animal presents a safety hazard to me, you, or itself.
  • You or your representative must be present and ready to catch and handle your animal for the duration of service. If you are not able to provide a handler, I can provide one at a rate of $30/hour, added to your invoice. If you require me to provide a handler, you must inform me when you make your appointment.
  • All animals must be clean and dry before they will be worked on. Wet and muddy animals will not be worked on because it is unsafe.

SAFETY

  • Safety for you, your animals, and me is vitally important. Work will stop if unsafe conditions arise, and will not continue until issue is corrected.
  • Work will not be carried out in wet, muddy fields.
  • A hard, level, clean surface must be available as a work space.
  • You must provide a clean, dry, well-lit work area indoors during rain.
  • Work will not take place outdoors in the rain.
  • An owner or responsible adult representative of the owner must be present at all times while animal is being worked on and is fully responsible for the animal.
  • Animals must be well trained and used to having their feet and legs handled and worked on. I am not an animal trainer, nor am I licensed as such. Proper training is the responsibility of you, the owner. If necessary, I can recommend trainers to help.
  • Any animal deemed unruly or dangerous will not be worked on until properly trained or sedated.
  • We reserve the right to choose whether or not work will be done on any animal. This is non negotiable for the safety of everyone involved.

PRIVACY

  • Client privacy is extremely important to me. Records are not currently stored online, to protect your privacy. Your records are available to you at any time, at your request.
  • Photographs of your animals, their feet, and other areas relevant to the work performed will be taken for monitoring progress, record organization, and business and educational purposes.
  • Images of your animal may be posted on social media for business and educational purposes. Anything distinctly recognizable (such as owner/handler faces, background, vehicles, etc) will be removed or blurred from the images. If your animal is well known, recognizable images of it will not be posted without your written permission.

PAYMENTS

  • TERMS: Payment is due IN FULL at time service is completed, unless other arrangements are made, in writing, before service is begun.
  • For payment purposes, ‘service’ refers to an individual visit to your location. Follow up visits for a continuing issue are considered separate services and must be paid on each service’s completion.
  • Certain well-established clients may be billed, with payment due net 15 days. If account becomes past due, a 1.5% fee per month will be added. If client becomes past due more than once in any 365-day (1 year) period, terms will be canceled and payment will be required at time of service, in cash.
  • METHODS: The following methods of payment are currently accepted, in order of preference: Cash, Venmo, check, money order, cashier’s check. Bartering for services and/or materials is also accepted on a case by case basis.

These are the complete terms and conditions of service and business with McMahan’s Hoofcare, and are subject to change without notice. These Terms and Conditions supersede any and all agreements between Shawn McMahan or McMahan’s Hoofcare and the Client, past or future. By engaging in business with Shawn McMahan or McMahan’s Hoofcare, you accept these Terms and Conditions in their entirety. Last revised 1/22/2024
